The following
are the 3 keys procedures in order to acquire a villa or an apartement
in "Les Jardins de la Lagune".
A - The preliminary agreement, which aims at reserving the property and allows
time to collect and gather the necessary documents.
The agreement is a booking contract set by a notorial officer.
B - The contract strictly speaking, which stipulates the final transfer of
the property between the parties, at the agreed price.
C - The registration of the property in the land-books which officially transfers
the property in the name of the acquirer.
Throughout the process, a notarial officer is in charge of setting up agreements
and contrats, taking into account legal, administrative and fiscal issues.
* The notarial officer must :
Verify the ID of the parties and their ability to conclude the deal.
* The acquirer must provide :
- A valid national ID card or passport ( for non Morroccans)
- In case of an acquisition in favour of a minor ( non Morroccan nor French),
a certificate attesting which one of both parents is allowed to sign for his
child is required.
- Information about his adress, place of birth, father's
name, marital status ( single, married...), date and place of marriage as well
as legal matrimonial
environment is also required.
* As for the payment terms (cash or bank financing): In case of a resell of
the property by the acquirer :
Non-residents in Morrocco are allowed to transfer abroad fonds resulting from
the sale only if the acquisition payment has been made in foreign currency.
A bank proof attesting the acquisition payment transfer will be required. |
